This policy is effective immediately for new users and from November 22, 2018, for all other users.
General Information
If you access Allyos services through the Allyos mobile application, additional terms of use apply.
By using the Allyos mobile applications, you confirm that you accept these terms.
Do the Mobile Device Terms Supplement the Allyos User Agreement?
Yes. You must comply with these terms each time you access Allyos services via a mobile device through the Allyos mobile application, in addition to the terms set out in the Allyos User Agreement.
What If I Do Not Agree with the Mobile Device Terms?
If you do not agree with these terms, please do not use the Allyos mobile applications.
Mobile Device Terms
If you access Allyos via a mobile device using the Allyos mobile application (“Application”), the following terms (“Terms of Use”) apply to you in addition to the User Agreement. By using the Application, you confirm that you accept these Terms of Use.
Use of the Application
Allyos grants you the right to use the Application solely for your personal use. While using the Application, you must comply with all applicable laws and third-party contractual terms (e.g., your wireless data service agreement). The Application may not include all the features available on the www.allyos.com website.
Intellectual Property – Applications
Allyos owns or holds licenses for all rights, titles, and interests related to the Applications, including all rights under patent, copyright, trade secret, trademark, unfair competition, and all other proprietary rights, including all applications, renewals, extensions, and restorations thereof.
You may not modify, adapt, translate, create derivative works, decompile, reverse engineer, disassemble, or otherwise attempt to derive the source code of the Application, nor may you remove, obscure, or alter any Allyos copyright, trademark, or proprietary notices placed on or embedded in the Application or accessible through it.
Policy on Prohibited Countries and Export Regulations – Applications
The Allyos Applications or the underlying technology may not be downloaded, exported, or re-exported:
(a) into Burma (Myanmar), Cuba, Iran, Iraq, Libya, North Korea, Sudan, Syria, or any other country subject to a U.S. embargo (or to nationals or residents thereof);
(b) to anyone on the U.S. Treasury Department’s Specially Designated Nationals list or the U.S. Commerce Department’s Denied Persons or Entity List;
(c) to any other country, person, end-user, or entity restricted under U.S. export laws.
By using the Allyos Application, you are responsible for complying with trade regulations and both foreign and domestic laws (e.g., you are not located in a country subject to a U.S. government embargo or identified as a “terrorist-supporting” country, and you are not listed on any U.S. government list of prohibited or restricted parties).
Additional Terms
Additional terms apply based on the mobile device used to install the Application:
iOS – Apple
These Terms of Use constitute an agreement between you and Allyos, not with Apple. Apple is not responsible for the Application or its content.
Android – Google (Alphabet)
- These Terms of Use constitute an agreement between you and Allyos, not between you and Google. Google’s terms of use and privacy policies for services such as the Google Play Store and billing services by wireless network operators do not apply to your use of the Application.
- You may not install or use a copy of the Application on a device you do not own or control.
Google, your device manufacturer, and (if applicable) your wireless carrier are not responsible for providing support services for the Application. - Google, any wireless carriers through whose network the Application is distributed (if applicable), and their respective affiliates, vendors, agents, and suppliers (collectively “Disclaiming Distributors”) make no express warranties or conditions regarding the Application.
- To the maximum extent permitted by local laws, the Disclaiming Distributors disclaim all implied warranties or conditions, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
- You assume all risks arising from your use of the Application (even if you have been advised of the possibility of damages).
You may have additional consumer rights under local laws that these Terms of Use cannot change. - To the extent permitted by law, you cannot claim any consequential, lost profits, special, indirect, or incidental damages from the Disclaiming Distributors.
